City Pacific Limited advises that yesterday, the Honourable Justice Dowsett of the Federal Court of Australia provided orders with regard to the future conduct of the proceeding, requiring City Pacific Limited to file and serve any amended originating process along with a statement of claim, on or before Friday, 3 July 2009.
A further directions hearing has been set for Monday, 6 July 2009, not before 11.00am. A date for a final determination of the matter has not yet been set by the court.
City Pacific confirms that it remains the responsible entity of the Fund, until such time as the Court otherwise determines the matters which are before it.
Ballot papers
City Pacific Limited confirms that at approximately 11.30am on Monday, 29 June 2009, it received from Balmain Trilogy, a computer disk containing copies of the ballot papers cast at the meeting of Unitholders on 25 June 2009. The Company has not yet had an opportunity to review each of the ballot papers recorded on the disk, though it is currently undertaking that task.
